The U.S. federal judiciary adopted a new policy aimed at curtailing 'judge shopping' by state attorneys general, activists and companies who file lawsuits challenging government policies in courthouses where one or two sympathetic judges hear most cases. The U.S. Judicial Conference, the judiciary's policymaking body, at a meeting in Washington, D.C., approved a policy that would require lawsuits seeking to block state or federal laws to be assigned a judge randomly throughout a federal district.U.S. Circuit Judge Jeffrey Sutton, newly appointed chair of the Judicial Conference's executive committee, said the change was prompted by the 'plethora of national, statewide injunctions' being issued by judges in such cases. The policy change followed calls by Democratic President Joe Biden's administration, Democratic lawmakers, and the American Bar Association for the judiciary to eliminate case assignment mechanisms that allow litigants to effectively choose which judges will hear their challenges to government policies.Read more: https://lnkd.in/gWSHQCCz#legal #judiciary #judgeshopping

Fascinating and heavily nuanced article. "Now comes an intriguing study by a Harvard Law School professor that buttresses my point (stating in all journalistic articles under what president federal judges were appointed): If anything, it suggests we have underestimated the impact of party affiliation on judicial outcomes. Alma Cohen, whose training is as an economist, examined 630,000 federal appeals court cases from 1985 to 2020 and found that the impact of party affiliation went far beyond hot-button issues such as guns or abortion.Rather, she wrote, “the political affiliations of panel judges can help predict outcomes in a broad set of cases that together represent over 90% of circuit court decisions. The association between political affiliation and outcomes is thus far more pervasive than has been recognized by prior research.” Note, Cohen isn’t contending that partisan affiliation affects 90 percent of cases — just that it has a statistically significant influence on outcomes in this large class of decisions.Cohen’s hypothesis is that Democratic judges and Republican judges “systematically differ in their tendency to side with the seemingly weaker party.” For instance, in civil litigation between individuals and institutions, such as the corporations or the government, “panels with more Democratic judges are more likely than those with more Republican judges to reach a decision that favors the individual party.”"https://lnkd.in/gvfgEdwrNow comes an intriguing study by a Harvard Law School professor that buttresses my point: If anything, it suggests we have underestimated the impact of party affiliation on judicial outcomes. "Women argued 40 percent of the office’s Supreme Court cases during the 2022 term, according to The Post’s analysis. That’s higher than the overall share of arguments delivered by women — 23 percent — before the court last term."Did you see the Washington Post article last week about diversity in the U.S. Solicitor General's office among Supreme Court litigators? If not, read it here: https://lnkd.in/eyPg-JKiIn Solicitor General Elizabeth Prelogar's brief tenure, more women are delivering oral arguments to the Supreme Court for her office than ever before. While racial diversity is still elusive in that office, it's encouraging that the number of women litigators in the Solicitor General's office is even higher than among the entire Supreme Court bar.Guess what? We have BINDERS of women who regularly argue before the highest court in the land.Peruse the list here - and fill out the firm if you'd like to be included in this list: https://lnkd.in/etbDQqg3#promotingwomenlawyers #representationmatters #DEI #genderequity #intersectionality
